The Sub-Divisional Officer, Rampurhat, Birbhum has filed a written instruction indicating that although the petitioner was found eligible to attend the interview for being appointed as an 'Asha' vide Notification dated January 13, 2020, she did not appear before the interview board. The petitioner appeared before the authorities for verification of her documents. After the documents were scrutinized she was required to appear before the interview board. The interview board waited for the petitioner but she did not turn up. Thereafter, the petitioner was also informed over phone that the interview board had been waiting for her. Still, the petitioner did not turn up.

These contentions of the Sub-Divisional Officer, Rampurhat, Birbhum are denied by the petitioner.

Such disputed question of facts cannot be decided by the writ court.

The Sub-Divisional Officer, Rampurhat, Birbhum shall intimate the petitioner the reasons as to why the petitioner was not considered for employment as an Asha Karmee under Joypur SubCentre. Such intimation shall be sent to the petitioner within a period of three weeks from the date of communication of this order.

It is made clear that if further advertisement is published for filling up the post of Asha, the petitioner shall be allowed to participate subject to fulfilment of the eligibility criteria.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
