Petitioner is aggrieved by the fact that in spite of having title over the property, the petitioner is obstructed from entering the property and it revealed that a forged deed was prepared which is the genesis of the dispute.

Petitioner also apprehends that their property would be sold out on the basis of such forged document/title deed which was existing and is in the possession of the private respondent nos. 4 & 5.

Learned advocate for the State has submitted a report which reflects that police authorities have registered a case being Pandua PS Case No. 763 of 2024 under the relevant provisions of Cheating and Forgery. The said case having been registered almost 9 months ago, I direct the

Investigating Officer of the case to send the progress report to the defacto complainant.

If the petitioner is aggrieved on receipt of the progress report regarding the manner in which the investigation is in progress, petitioner would be at liberty to take out an appropriate application before the jurisdictional Magistrate who would on receipt of such information ascertain and assess regarding the grievance of the petitioner and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 28255 of 2024 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
