Dismissed that the petitioner is in custody for 4 years 5 months and no material has surfaced in evidence against the present petitioner, still he has been detained behind the bars.

Learned advocate for the State submits that 16 witnesses have been examined already and the prosecution intends to examine two more witnesses.

Prosecution is directed to complete the examination and cross-examination of all the witnesses by 9th January, 2026. In case the evidence is not completed, learned trial court will release the petitioner on such terms and conditions as it deems fit and proper. However, in case the accused prays for time and delays the case, it is specifically directed that the learned trial court will not release the petitioner on bail.

With the aforesaid observations, CRM(M) 2617 of 2025 is disposed of.

State is directed to communicate this order to the learned trial court for immediately taking prompt action. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
