After hearing the petitioner and the alleged contemnors and considering the compliance report filed by the added contemnor no.4 and in particular the letter dated 26th April, 2024 annexed at page 8 of the said compliance report duly signed by A.K.Swarnakar, A.S. (FIN(PEN)), it is clear that the Finance Department has no objection in counting past services in favour of the petitioner rendered as Lower Division Assistant at After Care Home, Baharampore, Murshidabad under erstwhile Directorate of Social Welfare for the period from 02.12.2002 to 22.12.2005 and as Bench Clerk-II under the judgeship of 24-

Parganas (South) on redeployment basis for the period of 23.12.2005 to 23.05.2012. It is apparent that the order under contempt has been complied with. The Judicial Department, Government of West Bengal is directed to act on the basis of the said letter issued by the Finance (Pension Department) and grant the benefit as indicated in the said letter at the earliest. Nothing further remains to be decided in this contempt application. The contempt application is disposed of recording compliance as aforesaid. The disposal of the contempt application will, however, not prevent the petitioner from ventilating any grievance by filing appropriate proceedings as the jurisdiction under contempt only empowers the Court to scrutinize whether the order has been complied with or not.
