Petitioner(s) Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha Ms. Upasana Banerjee ... for the Petitioner(s) Ms. Sreyashee Biswas Ms. Trina Mitra ... for the State-respondent(s) Learned advocate for the petitioner submits that the accusations of the prosecution are to the extent that from the joint possession of the petitioner and another, 25 kg of ganja were recovered. Learned advocate also submits that the petitioner is in custody for one year four months and thirteen days. According to the learned advocate there is no scope of the trial being concluded very soon, as such, on any stringent condition, the petitioner may be released on bail.

Additionally, it has been submitted that the other accused has already been granted bail.

Learned advocate for the State opposes the prayer for bail. However, so far as the issue relating to parity is

concerned, no distinction can be made behalf of the prosecution.

Having considered the totality of the circumstances, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Ananda Dey shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Additional Sessions Judge, 1st Court & Judge, Special Court (NDPS Act), Jhargram. If on bail, the petitioner shall be physically present on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of Jhargram without prior permission of the learned Trial Court/Special Court Accordingly, CRM(NDPS) 1630 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
