Kausik (Rejected) CRM (M) 2619 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sagardighi Police Station Case No. 135 of 2023 dated 18.04.2023 under Sections 363/201/302/379/411/120B/34 of the Indian Penal Code, 1860.

Petitioner is in custody for 2 years and 11 months and the report submitted by the State reflects that 18 witnesses have been examined out of the proposed 35 witnesses. I have taken into account the earlier orders passed by the co-ordinate benches wherein it has been specifically observed regarding the incriminating materials herein as well as the heinousness of the offence of stabbing a 17 year old boy after he was allegedly abducted.

Having regard to the fact that the accused persons who were granted bail were taken into consideration in CRM (DB) 2742 of 2024 and CRM (M) 163 of 2025, I am of the opinion that there has been no change of circumstances in favour of

the present petitioner. However, a substantial time has passed. As such, the prosecution is directed to complete rest of the witnesses by 31st March, 2027.

At this stage, considering the fact that trial of the case has taken a shape, I am of the view, releasing the petitioner would jeopardize the further progress of the trial. Accordingly, the prayer for bail of the petitioner in CRM(M) 2619 of 2025 is dismissed.

Petitioner would be at liberty to approach this Court if there is no substantial progress in the case within the time frame directed above.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
