Dismissed that the petitioner is in custody for 157 days and the charge-sheet having been submitted there is hardly any reason to detain the petitioner any further in custody.

On the other hand, learned advocate for the State has drawn the attention of the Court to the statement under Section 164 Cr.P.C. of number of witnesses. Attention has also been drawn to the seizure list where certain recoveries were made. Learned advocate for the petitioner submits that after four months of the incident the victim expired. Be that as it may, since the eyewitnesses as well as the seizures which point towards the present petitioner and the fact that the principal accused is still absconding, I am not inclined to

release the petitioner on bail.

Accordingly, CRM(M) 2620 of 2025 is dismissed. However, the learned Magistrate in seisin of the case is directed to supply the copies under Section 207 of the Cr.P.C. to the present petitioner so that he is able to understand the case against him.
