APP Ms. Rita Dutta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was earlier granted bail, but, subsequently, for miscommunication, he did not appear before the court and, on warrant being issued, he surrendered. However, since then, he is in custody for about 75 days.
It has also been contended that the majority of the accused persons have been arrested.
Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that some of the accused persons are absconding.
In view of the aforesaid, I direct the learned trial court to split up trial of the case after exhausting whole of the process of law, thereafter, proceed with the trial of the case in accordance with law.
Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Rejected.
However, the petitioner would be at liberty to approach this court after the stage of consideration of charges is over.
Accordingly, CRM(M) 2622 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
