Modification is sought of this Court's order dated 22nd December, 2023.

It is submitted that after clearing the encroachment in front of the petitioner's land, the land has been dug up and fenced in such a manner that the petitioner is unable to access his own land. 3.

The petitioner shall be entitled to access his own land.

The Officer-in-Charge, Nandakumar Police Station shall ensure that the petitioner has appropriate access to his land. If necessary for the aforesaid purpose, the petitioner may fill up the ditch in front of his premises and cut off the fencing to the extent of having access to his own land.

The concerned Assistant Engineer, PWD shall ensure compliance of the aforesaid order under the aegis of Nandakumar Police.

With the aforesaid direction CAN 1 of 2024 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
