Wasim Akram Ms. Sabrina Parveen ... for the petitioners Mr. Joydeep Biswas Mr. Sufi Kamal ... for the State Learned counsel for the petitioners submits that the petitioner No.1 is 78 years old. The petitioner Nos.4 to 7 are female members of the family. There was a land dispute between the family members. The principal accused, who had assaulted the victim, is in custody.
Learned counsel for the State strongly opposes the prayer for anticipatory bail, refers to the statements of local witnesses recorded by the police as well as before the learned Magistrate and relies on the injury report and the postmortem report. It appears from the statement of a local witness recorded before the learned Magistrate that active roles have been ascribed even to the petitioner Nos.4 and 5.
Considering the above and the other materials available in the case diary, while I am inclined to grant anticipatory bail to the petitioner Nos.6 and 7, who are the female members of the family and against whom apparently there are no specific roles ascribed by any of the witnesses, the application for anticipatory bail of the petitioner Nos.1, 2, 3, 4, 5 and 8 (Rohini Mandal, Ranjit Mandal, Ananda Mahaldar @ Ananda Mandal, Chhakiyan Mandal @ Chakiya Mandal, Shibani Mandal and Gouranga Mandal @ Gouranga Chandra Mandal) is rejected.
In the event of arrest, the petitioner Nos.6 and 7 (Sulekha Mandal and Rupali Mahaldar @ Rupali Mandal)) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner Nos. 6 and 7 shall cooperate with the investigation and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
