Learned counsel appearing for the petitioner submits that the matter is still pending before the Debts Recovery Tribunal and as such the Consumer Forum has no jurisdiction to entertain this matter.

It appears that in the written statement before the Consumer Forum, the petitioner/opposite party has not raised the point of maintainability before the Forum. As such this revisional application is disposed of with the direction that the petitioner is at liberty to raise the point of maintainability before the Consumer Forum within 15 days from the date of this order which the Consumer Forum shall consider and dispose of the same in accordance with law.

There will be no order as to costs.
