The S.I. of Schools, Kakdwip Circle, South 24 Parganas, has filed a report dated April 16, 2024, which is taken on record. A copy of the same has been served to the counsel for the petitioner.

It appears from the report that the petitioner has been guilty of unauthorized absence for a substantial period of time.

This Court also notes that the respondent DPSC has not taken any step against the petitioner for such unauthorized absence or for regularization of the same against the available leave or any other measure.

In those circumstances, the DPSC, South 24 Parganas shall take a decision in the matter in so far the unauthorized absence of the petitioner is concerned.

In the event of any issue outside of the scope of the DPSC's authority, it may refer the matter to the Commissioner of School Education/WBPPE as the case may be.

It is expected that the petitioner shall be given a personal hearing before any final decision is arrived at by the DPSC/WBBPE/Commissioner of School Education. It is also expected that such decision shall be taken within a period of 2 months from date.

The writ petition shall stand disposed of.

There shall be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
