Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 7 months and there has been no progress in the trial of the case, as such, the petitioner may be released on bail on any stringent condition.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.
Records reflect that bail of the petitioner was lastly rejected on 27.08.2025 by the co-ordinate Bench of this Hon'ble Court. As the petitioner is in custody for a considerable period of time and there has been no progress in the case, I direct the learned Public Prosecutor appearing in the court below to submit a list of vulnerable witnesses to
the learned Trial Court. Learned Trial Court would assess as to whether each of the witnesses are vulnerable or not. Thereafter, ask the learned Public Prosecutor to fix the chronology of witnesses concerned, with priority to the vulnerable witnesses.
Petitioner would be at liberty to renew his prayer for bail after the examination of the vulnerable witnesses is over preferably within a period of eight months from the date of communication of this order.
Learned advocate appearing for the State would through the Investigating Officer of the case place this order before the learned Trial Court immediately on the next date so fixed.
At this stage, the prayer for bail of the petitioner is rejected.
The application for bail, being CRM (M) 2703 of 2025, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
