22.12.2025
IN THE HIGH COURT AT CALCUTTA
Item No.36 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.
C.R.M. (M) 2659 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kandi Police Station Case No. 219 of 2013 dated 11.04.2013 under Sections 341/326/307/34 of the Indian Penal Code and Sections 3/4 of the Explosive Substances Act (G.R. Case No. 482 of 2013).
And In Re :
Firoj Sk.
... Petitioner.
Mr. Manas Kumar Das, Mr. Aritra Kumar Thokdar ... For the Petitioner.
Mr. Parthapratim Das, Ms. Pallabi Priyadarshi ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 11 months 15 days and other accused persons similarly placed have been granted bail by the learned court below. Petitioner prays for bail on any stringent condition.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner had been absconding since 2013. As such, there is every possibility of the petitioner jeopardizing whole of the trial, in case he is released on bail.
Be that as it may, since the other accused persons are on bail, I direct the learned Trial Court to release the
petitioner on bail after the charges are framed by the learned Trial Court.
With the aforesaid observations, the application for bail, being CRM (M) 2659 of 2025, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
