This revisional application has been filed with a prayer for quashing of the proceedings pending before the learned Additional Chief Judicial Magistrate, Barrackpore in connection with Dum Dum Police Station Case No. 840 of dated 27.11.2013 under Sections 323/354/5014/341/34 of the Indian Penal Code, corresponding to G.R. No. 5760 of 2013.

From the record, it appears that the revisional application was filed in the year 2015 with a prayer for quashing of proceedings, which was initiated on a complaint dated 27.11.2013. From the certified copies of the ordersheet submitted on behalf of the opposite party, it is found that chargesheet was submitted on 08.06.2015 and charge was framed on 28th December, 2017 and all the petitioners participated in the trial after framing of charge and contents thereof was read over and

explained to the petitioners/accused to which they pleaded not guilty and claimed to be tried. Accordingly, the case was put into trial fixing dates for evidence In this circumstances, I find no reason to quash the proceedings in terms of application under Section 482 which, in my opinion, has become infructuous. From the record, it appears that the revisional application is pending since 2015, and the case is also pending for evidence before the learned Trial Judge since 2017. Accordingly, learned Judicial Magistrate, 4th Court, Barrackpore is requested to disposed of this case as expeditiously as possible.

The certified copies of ordersheeet filed by the opposite party and the status report of the case submitted by the State be kept with record.

With the aforesaid observation the revisional application stands disposed of.

Connected applications, if there be any, also stand disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

All parties to this revisional application shall act on the server copy of this order downloaded from the official website of this Court.
