The contempt application is heard in presence of the learned advocates representing the applicant and alleged contemnors including District Inspector of Schools (SE), Siliguri.

The learned advocate representing the school authorities of Patharghata High School (HS) submits that the order passed by the coordinate Bench dated 25th July, 2005 has been complied with. In support of such submission copy of the letter dated 5th February, 2024 issued by the teacher-in-charge of the said school along with copies of postal slips and tracking report are placed before this Court and the same are taken on record. Copies of these documents have also been made over to

the learned advocate representing the applicant in course of hearing.

On perusal of the letter dated 5th February, 2024 it appears that the panel in question has been recast upon awarding marks on account of the certificate granted by Utkal Univesity. Therefore, the position of the applicant in the panel has been upgraded from third position to first position. The revised panel has been sent under registered post to the concerned District Inspector of Schools (SE), Siliguri on 27th February, 2024 and the same has been received by the Office of District Inspector of Schools on 1st March, 2024.

In view of the aforesaid steps taken by the alleged contemnor there is no need to keep this contempt application pending.

Accordingly, the contempt application stands disposed of and contempt proceeding stands dropped. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
