Petitioner Mr. Tapodip Gupta Mr. Suman Bhanja ....for the petitioner Mr. Saryati Datta Mr. Sachit Talukdar ....for the State Learned advocate appearing for the petitioner submits that the petitioner is a driver of the vehicle who has been detained while the owner of the vehicle has been released on bail. Petitioner claims that he has been detained allegedly for seizure of 105 kgs. of acetic anhydride.

As the charge-sheet has been submitted petitioner prays for bail on any stringent conditions.

Learned advocate appearing for the State opposes the prayer for bail and submits that the charges have already been framed in the month of March, 2025. However, none of the witnesses have been examined and the next date is fixed on February 2, 2026 for witness action.

State is directed to give priority to the seizure list witnesses first. Consequently in the month of February, 2026

arrangements be made for examination of the two seizure list witnesses.

After the examination-in-chief and crossexamination of the seizure list witnesses are over, petitioner be released on bail on such terms and conditions as the learned Special Court deems fit and proper for ensuring the further presence of the petitioner in course of the trial. With the aforesaid directions CRM (NDPS) 1603 of 2025 is disposed of.

Reported submitted by the State be kept with the record.
