Learned advocate appearing for the petitioner has challenged the continuance of Women Police Station, Howrah Police Commissionerate Case No. 47/2024 dated 10.09.2024.

The main thrust of contention is that the information which was furnished before the police authorities were exclusively on the claims relating to maintenance, and as such according to the petitioner no offence under the relevant provisions of the IPC/BNS has been made out.

Learned advocate appearing for the state has submitted a report which reflects that the police authorities, after conclusion of investigation, has

already submitted charge sheet against the present petitioner under the relevant provisions of law. Learned advocate for the private respondent nos. 6 and 7 is present.

Having considered that the investigation of the case has already been concluded, I grant liberty to the petitioner to canvass all the issues at the time of consideration of charges before the learned Magistrate in seisin of the case.

With the aforesaid observations WPA 28276 of 2024 is disposed of.

Report so submitted be kept with the record.
