1. The written instructions filed by the respondent WBSEDCL is kept with the record.

2. This is the second round of litigation between the parties. In a prior writ petition by an order dated 25th April, 2025, a Coordinate Bench had disposed of the writ petition granting liberty to the petitioner to file an application before the District Magistrate for resolution of the disputes under section 3B of the Works of Licensees Rules, 2006. Significantly, the said order directed the District Magistrate to hear the petitioner and all other parties and concerned individuals.

3. It is submitted on behalf of both the petitioner and the respondent WBSEDCL that notwithstanding the directions in the order dated 21st April, 2026 the District Magistrate has refused to comply with the said direction and has not heard any of the parties.

4. In view of the above, the order dated 4th August, 2025 is nonest and in violation of the order passed by the Coordinate Bench dated 25th April, 2025.

5. The order dated 4th August, 2025 is set aside. The District Magistrate is directed to act in terms of the order dated 25th April, 2025 and pass a reasoned order after hearing all the parties.

6. With the above directions, WPA 27777 of 2025 stands dispose of.

7. It is made clear that there has been no expression on the merits of the case and all questions are left open, to be decided by the District Magistrate in accordance with law.
