The petitioner claims to be the recorded owner of 11.5 decimals of land in R.S. Plot No. 11 corresponding L.R. Plot No. 128 of Mouza-Muransole, J.L. No. 190 under Police Station-Binpur, District- Jhargram and complains that one signboard was put up in the said plot demonstrating construction of auditorium with boundary wall on the said land though the land was not acquired in due process of law. The petitioner seeks liberty to submit a comprehensive representation ventilating his grievance before the concerned authority and prays for direction upon the authority to consider the representation at the earliest.
It is submitted on behalf of the State respondents that such representation be directed to be considered by the third respondent, in accordance with law. In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation ventilating his grievance before the third respondent within two weeks from date. The third respondent is directed to consider and dispose of the said representation within one month from the date of receipt thereof upon affording reasonable opportunity of hearing to all the interested persons including the petitioner, in accordance with law.
The decision taken by the Authority shall be communicated to the petitioner within a week thereof. The writ petition is thus disposed of.
Pending disposal of the representation, no construction/further construction shall be made by the State respondents in the plot in question.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
