Affidavit of service filed by the petitioner and report submitted by the State are taken on record.

Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the property in question was leased out in favour of the petitioner by the father of the 5th respondent. The lease is valid till 2033. The petitioner has been paying lease rents regularly. The private respondents are trying to evict the petitioner from the said property and have been putting padlocks to the property time and again.

The petitioner lodged complaint before the police authority which was not acted upon. It appears from the report submitted by the State that FIR has been registered pursuant to the complaint lodged by the petitioner and investigation is in progress.

The police authority is directed to conduct the investigation in a fair, unbiased and impartial manner and

take the same to its logical conclusion in accordance with law. The police authority shall also render adequate assistance/protection to the petitioner in order to avoid breach of peace and any untoward incident, as and when approached by the petitioner.

With the above observation and directions, the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
