The petitioners seek relief under the Bangla Awas Yojona. The Block Development Officer has caused an enquiry and has found that twelve (12) petitioners are not entitled to get the benefit under the Rural Housing Scheme but the balance five (5) will be eligible in accordance with the scheme.

The Additional District Magistrate and the Additional Executive Officer of the South 24-Parganas Zilla Parishad has forwarded an undated report to the Court mentioning that the names of the eligible petitioners will be forwarded to the Panchayat and Rural Development Department for consideration. The last list for recommendation of beneficiaries was prepared in the year 2018.

The petitioners who have been found eligible for the benefit under the scheme are Tuktuki Paik, Maidul Paik, Hasan Purkait, Jamuna Halder and Selim Paik. One of the petitioners namely Saidul Peyaeda, son of Hamid Paik could not be traced.

Enquiry report forwarded by the State respondents be retained with the records. Let a copy of the same be handed over to the learned advocate appearing on behalf of the petitioners.

The writ petition is disposed of by directing the concerned officer in the office of the District Magistrate, South 24-Parganas to make necessary recommendation in favour of the eligible petitioners for enlistment of their name in the list of beneficiaries under the Rural Housing Scheme to be prepared in future.

The writ petition stands disposed of.

Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
