Mr. Sarbananda Sanyal Mr. Hamidur Rehman Mr. Saikat Gayen ....for the petitioner Mr. Lalit Mohan Mahata, AGP Mr. Prasanta Behari Mahata ....for the State Affidavit of service filed in Court today is taken on record.
The petitioners have alleged inaction on the part of the respondent authority in not demarcating the PWD road.
Mr. Mahata, learned Additional Government Pleader submits that the petitioners have submitted various representation before the authorities praying for demarcation of plots belong to the private individuals. He submits that appointment of Government Amin and Surveyor for demarcation of plots in occupation of private individuals cannot be made. He draws attention of the Court to the representation dated October 24, 2025 wherein the petitioners have alleged that after a Bata Plot being No.1454/5534 has been curved out from the original Plot No.1454, the original plot and the Bata plot has been
demarcated in the mouza map for which the parties are facing difficulties in their possession.
Faced with such situation, Mr. Sanyal, learned advocate appearing for the petitioners prays for leave to file a representation before the authorities praying for demarcation of the PWD road.
In the light of the submissions made by Mr. Sanyal, WPA 28027 of 20258 stands disposed of by giving liberty to the petitioners to file an appropriate representation before the respondent authorities and if such a representation is submitted, the concerned respondent authority shall consider and dispose of the same by passing a reasoned order as expeditiously as possible but positively within a period of 8 weeks from the submission of the representation along with a server copy of this order. There will be no order as to costs.
