By the impugned order, this Court was pleased to direct the petitioner to deposit his passport before the Trial Court before his release from the correctional home.

Learned Counsel appearing on behalf of the petitioner submits that he has deposited his passport before the court below in terms of order and now he may be given liberty to pray before the Court below for getting back the passport for a limited period. Learned Counsel appearing on behalf of the NCB raised objection contending that huge quantity of narcotic substances was recovered from the possession of the petitioner and he is a habitual offender and he has engaged himself in international smuggling and

he is also the financer of the seized drugs and on previous occasion steroid amounting to Rs. 10 lakhs was seized from the possession of the present petitioner in the month of September, 2019. Having heard learned Counsel appearing on behalf of the petitioner and the NCB, liberty is given to the petitioner to approach before the Trial Court to get back the passport and in the event of making such prayer by the petitioner, the Court below will dispose of such prayer in accordance with the facts and circumstances of the case including chance of causing delay in trial by the petitioner and also in accordance with law, without being influenced by any observations made herein.

Accordingly, the application being CRAN 1 of 2025 is disposed of. (Dr. Ajoy Kumar Mukherjee, J.)
