It is unfortunate to note that an application under Section 125 of the Code of Criminal Procedure is pending for more than six years in the Court of learned Judicial Magistrate, 2nd Court, Serampore, Hooghly. The statute suggests time bound disposal of the application under Section 125 of the Cr.P.C. An application for maintenance ought to be disposed of with utmost expedition in order to save a destitute lady from vagrancy. The learned Judicial Magistrate is not a aloof to the dictum of the statutory provision of the plethora of decision on this point delivered by the Hon'ble Apex Court and all the High Courts of the country. Under such circumstances, the learned Judicial Magistrate, 2nd Court, Serampore, Hooghly is directed to dispose of Misc. Case 247 of 2016 within three months from the date of this order positively.
The instant revision is disposed of.
