AD 41 January 6, 2026 Ct. 28 SG CRM(A) 4172 of 2025 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Malda P.S. Case No.687 of 2025 dated 29.09.2025 under Sections 85/103(1)/3(5) of the BNS.

Khan Mr. Mujibar Ali Naskar ... for the State Learned counsel for the petitioners submits that the petitioners are the parents-in-law, the sister-in-law and the brother-in-law of the alleged victim. After the incident, the husband became mentally unstable. The marriage between the couple took place about 8 years ago. On the fateful day, the victim allegedly committed suicide after killing her two minor children. Learned counsel for the State opposes the prayer for anticipatory bail, refers to the statements of local witnesses recorded before the police as also before the learned Magistrate and the statements of the relatives of the victim and the postmortem report and submits that it appears from the statements of witnesses that it was the father-in-law who took the victim to the hospital and it was the mother-in-law who informed others about the incident. It also appears from the statements that the couple has been residing elsewhere for some time. It was only about three

months prior to the incident that they had come back to the matrimonial home.

It is, indeed, a very unfortunate case where a married lady purportedly decided to murder her own children and then committed suicide by hanging.

However, considering the above, the other materials available in the case diary and the alleged roles ascribed to the present petitioners, I am inclined to grant anticipatory bail to the petitioners. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall cooperate with the investigation, shall not threaten or intimidate witnesses and the petitioner Nos.1 and 4 shall meet the investigating officer once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
