No. 29 CHC Rejected C.R.M.(A) 5353 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bardhaman Women Police Station Case No. 401 of 2023 dated 28.08.2023 under Sections 420/406/328/323/34 of the Indian Penal Code, 1860.

And In the matter of : Anirban Narayan Choudhury & anr. ...... petitioners Mr. Subrata Bhattacharjya ....for the petitioners Mr. Bidyut Kumar Ray, Ms. Ayantika Ray ....for the State Materials in the Case Diary suggest that, petitioners obtained automated teller machine (ATM) debit card of the de facto complainant and withdrew money without the consent of the de facto complainant.

Considering the gravity of the offence and in the involvement of the petitioners in the incident, we are unable to grant anticipatory bail to the petitioners.

This application for anticipatory bail is, thus, rejected. CRM(A) 5353 of 2023 is disposed of.
