1. Heard learned lawyers for both the parties.

2. We have considered the materials on record. Statement of the son of the deceased before Magistrate discloses role of the petitioner in threatening the deceased prior to the incident. He was a part of the conspiracy to commit the murder. He does not stand on the same footing with co-accused who have been enlarged on bail. Accordingly, we are not inclined to grant bail to the petitioner.
