Learned advocate appearing for the petitioner submits that the petitioner is the helper of a truck which was carrying 15,000 bottles of phensedyl. It has further been submitted that two of the accused persons have been granted bail. Petitioner is in custody for 1 year, as such, on any stringent conditions, the petitioner may be released on bail.

On the other hand, learned advocate for the State submits that the two accused persons who have been released on bail were implicated in the case on the basis of statement of coaccused and there has been no recovery from the said accused persons. Charge has already been framed and prosecution intends to examine 12 witnesses in support of its case and the next date has been fixed on 8th January, 2026.

Having considered the quantum of seizure, I am of the

opinion that rigors of Section 37 of the NDPS Act is attracted. Accordingly, the prayer for bail of the petitioner in CRM(NDPS) 1595 of 2025 is dismissed.
