The petitioners are aggrieved by the fact that immediately after the police authorities along with the KMC implemented the order of the learned Executive Magistrate, the encroachers within a close proximity of time reverted back to their original position and the

purpose for which the order was passed by the learned Executive Magistrate has become futile.

A report has been submitted by the learned advocate for the State. Let the same be kept with the record.

Since the order was passed by the learned Executive Magistrate, this Court will not interfere with the order so passed by the Executive Magistrate.

However, the petitioners would take appropriate steps before the learned Executive Magistrate whose order, if any, has been violated.

With the aforesaid observations, WPA 28303 of 2024 is disposed of.
