The present writ petition is preferred as the 23.04.2025 Court No. 35 Item No.16 Rakib warrant of arrest in connection with M. Ex. 583 of 2023 was not being executed.

Mr. Dutta, learned advocate appearing on behalf of the State submits a report prepared by the Officer-inCharge, Missing Person Squad, Detective Department, Lalbazar, Kolkata wherein it reflects that the respondent no.7 namely, Vivek Ray Chowdhury was arrested at Darjeeling and was thereafter produced before the learned Judicial Magistrate, 4th Court, Alipore on 19.04.2025 and has been taken into custody in connection with the aforesaid case.

Having considered that the police authorities have executed the warrant of arrest, further pendency of the writ petition is unwarranted. The petitioner would take all further steps before the learned Judicial Magistrate, 4th Court, Alipore which is in seisin of M. Ex.583 of 2023. Accordingly, WPA 28308 of 2024 is disposed of.

Report so submitted by the State be kept with the record.
