The contempt application is taken up for consideration pursuant to the order dated 13th January, 2023 in presence of the learned advocate representing the applicant.

It has been submitted by Mr. Mondal, learned advocate, representing the applicant that Commissioner of School Education, West Bengal has communicated the decision vide memo dated 9th February, 2023 in the meantime. The copy of the memo dated 9th February, 2023 is taken on record. In view of the communication of the decision by the alleged contemnor it appears that order dated 2nd August, 2022 has been complied with. Accordingly, the contempt application stands disposed of.

However, this order shall not preclude the applicant to take appropriate legal steps against the said decision which has been communicated by the alleged contemnor, if so advised.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
