Mr. Debabrata Saha Ray Mr. Pingal Bhattacharyya Mr. Subhankar Das ....For the petitioner Mr. Suman Sengupta Ms. Amrita Panja Moulick .....For the State Respondent Petitioner's application for appointment of compassionate ground was not decided by the State authority in respect of FPS dealership of petitioner's deceased father but the State authority had issued a new vacancy notification which is under challenged in this writ petition.

After hearing by the parties, this court has passed an interim order on 9th December, 2024. The State respondent used affidavit, wherefrom it appears that the petitioner's prayer for appointment of compassionate ground was rejected by the concerned authority.

Learned counsel appearing on behalf of the petitioner submits that the petitioner intends to challenge the order passed by the concerned authority by placing a separate writ petition. So, he prayed for

disposal of the instant writ petition with a liberty to sue afresh.

Having heard learned counsel for parties and considering the entire aspects, the instant writ petition is disposed of with a liberty to sue afresh.

Interim order, if any, passed by the court is hereby vacated.

Connected application, if pending, are also disposed of.
