Kausik (Rejected) CRM (M) 2644 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Karimpur Police Station Case No. 157 of 2024 dated 27.08.2024 under Section 85/80/103/3(5) of the BNS, 2023 and Section 3/4 of Dowry Prohibition Act, 1961.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 359 days and till date the case has not been committed before the Court of Sessions, as such on any stringent condition petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that one of the accused person is absconding which is the reason for the delay.

Records of the case reflect on inspection that the victim/deceased met her end within two and half months of marriage. Having regard to this I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 2644 of 2025 is dismissed. However, learned Trial Court is directed to split up the trial, if required, and commit the case to the Court of Sessions at the earliest while exhausting the process of law. Learned Sessions Court within one month from the date of receipt of the record should take steps for overcoming the stage of consideration of charges.

Petitioner would renew his prayer for bail after the charges are considered or framed by the learned Trial Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
