Learned counsel for the petitioner submits as follows. The petitioner was duped of paying a sum of Rs.3,24,000/- for obtaining a loan of Rs.5 lakhs. The bank in question was contacted and documents were seized. But, only warrant of arrest was issued against the accused Gulfam Saifi and Prem Kumar. On the prayer of the petitioner, this Court by an earlier order dated 08.06.2023 passed in WPA 11345 of 2022 transferred the investigation of Behala PS Case No.317 dated 18.10.2020 to the CID, West Bengal. Even after that, hardly any investigation has been done. Learned counsel for the State relies on the report and submits as follows. After taking over investigation of

the case, the CID has taken several steps during investigation. It was found that there was no existence of the company "Shiv Shakti Finance" in Gurugram, Haryana. Technical assistance was taken to fix up the users of the mobile attached to the beneficiary bank account. Further assistance was sought to analyse some other mobile numbers. Raids were held in different places including in Uttar Pradesh. A team of officers went to Gautam Buddha in Noida. Searches were conducted at Aligarh and other places. Finally, a team of the CID held a raid in Telengana and secured the arrest of one accused Biswajit Das. The Court has already issued order of attachment of property against the absconding accused Gulfam Saifi. Investigation is going on and a report in the final form would be filed soon. It appears that the CID has taken several steps while investigating the case. One accused has been arrested from Telengana and an order of attachment has been issued against another accused.

Let the investigation be concluded expeditiously and in accordance with law.

No further order need be passed in this regard. With these observations, the writ petition is disposed of.
