Learned advocate for the petitioner submits that he lodged a complaint on 24.08.2023 but the police authorities of Durgapur Police Station did not take any action.

Learned advocate for the State has submitted a report. Report reflects that the present petitioner did not pay certain amount in respect of the cheques. A case being Andal PS Case No.06/22 dated 06.01.2022 was registered against the petitioner which ended in a charge sheet. Subsequently on the complaint of Mousam Banerjee, another case being NTS PS Case No. 99/20 dated 07.08.2020 was initiated and chargesheet has also been submitted in connection with the said case. The petitioner complains that the genesis of this case and the cheques are issued on the basis of forged agreement.

Be that as it may, prima facie, the police authorities have acted on an overall assessment of the circumstances as such prima facie I do not find that the police authorities are at fault. The conduct of the present writ petitioner reflects that he is trying to circumvent the

persons, the proceeding and/or any litigation which can be initiated against him for not paying his creditors. In view of the aforesaid, no interference is called for.

With the above observations, WPA 26902 of 2023 is dismissed.

Report submitted by the State be kept with the records.
