Allowed that the subject matter of the case relates to recovery of 125 bottles of phensedyl and the petitioner has been implicated on the basis of statement of co-accused. There has been no recovery from the present petitioner and the petitioner is in custody for more than 6 months, as such, on any stringent conditions, the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that the next date has been fixed for consideration of charges.

I have taken into account the factum that the petitioner has been implicated on the basis of the statement of co-accused persons, as such, I am of the view that further detention of the

petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner namely, Sanjay Sikdar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 6th Court, Barasat, 24 Parganas (North). If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of 24 Parganas (North) without prior permission of the learned special court.

Accordingly, CRM (NDPS) 1597 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
