Rafikul Islam @ Rafikul and others ... petitioners Md. Wasim Akram ... for the petitioners Ms. Baisali Basu Mr. Subhajit Chowdhury ... for the State Learned counsel for the petitioners submits that the petitioners are day labour. Due to some miscommunication, the petitioners could not surrender before the learned jurisdictional court within four weeks as directed by a Division Bench of this Court on 09.12.2024 in CRM(A) 4188 of 2024 while granting anticipatory bail to the petitioners. Learned counsel for the State submits that although the order was passed in December, 2024, the present application was affirmed in the month of March, 2025.

It appears that the petitioners were granted anticipatory bail on 09.12.2024.

Due to some unavoidable circumstances, they could not surrender before the learned jurisdictional court in time.

In view of the above and in the interest of justice, the petitioners are directed to surrender before the learned jurisdictional court and pray for regular bail within four weeks from this date. The rest of the order granting anticipatory bail and other conditions shall remain unchanged.

Accordingly, CRAN 1 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
