Kausik (Allowed) CRM (M) 2650 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ratua P.S. Case No. 512 of 2025 dated 23.06.2025 under Section 85/80/3(5) of the BNS, 2023.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about six months and the death of his wife was because of consuming poison. Other accused persons who have been implicated in connection with the instant case has been granted bail or are on anticipatory bail.

Learned advocate for the State opposes the prayer for bail and submits that within one year of marriage the deceased had to end her life because of torture inflicted by the in-laws of the matrimonial home.

I have taken into account the materials collected by the Investigating Agency as also the other medical documents which are appearing. On an assessment of the same along with the period for which the petitioner has been detained, I am of the opinion further detention is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Asik Muktar Alam @ Samrat @ Samrat Ansari shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Chanchal, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the said Court and shall not leave the jurisdiction of the District of Malda without prior permission of the said Court.

Accordingly, CRM (M) 2650 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
