Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for more than two years one month. The evidence of the case before the learned trial Court has progressed. Learned advocate has also drawn the attention of the Court to the deposition of the victim. Learned advocate for the State opposes the prayer for bail and relied upon the statement under Section 164 of the Cr.P.C. of the victim.
I have taken into account the materials which are appearing and the fact that the vital witnesses (8) out of 15 witnesses having been examined.
Having regard to the same, I am of the view that further detention of the petitioner at this stage is unwarranted. As such the prayer of the petitioner is allowed. Accordingly, petitioner namely, Md. Rinku shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Exclusive POCSO Court, Asansol, Paschim Bardhaman.
If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Paschim Bardhaman without the prior permission of the learned trial Court.
As such, the application for bail being CRM (M) No. 2691 of 2025 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
