Ms. Pampa Dey Dhabal Ms. Sangita Banerjee .....for the petitioner Mr. Debashis Banerjee Mr. Rakesh Jana ....for the respondent no. 2 Mr. Jayanta Samanta Mr. Subhendu Sengupta ....for the State respondent nos. 1, 3 & 4 1) By presenting this writ petition petitioner has made a prayer for reckoning his date of promotion to the post of Lower Division Clerk under Judgeship of Paschim Bardhaman from 9th September, 2018 instead of 10th August, 2022.

2) It is submitted by learned advocate representing the petitioner that vide promotional order dated 18th May, 2022 petitioner was granted notional benefit relating to his promotion to Lower Division Clerk from date when vacancy arose in Lower Division Clerk cadre against which petitioner was promoted.

Therefore, according to the petitioner, at the time of preparing gradation

list 9th September, 2018 may be reckoned as date of promotion not 10th August, 2022.

3) During course of hearing, learned advocates representing respondents have jointly submitted that touching upon the issue of promotion based on order dated 18th May, 2022 another writ petition being WPA 10519 of 2022 is pending. It is also submitted that petitioner was impleaded as respondent in said writ petition being WPA 10519 of 2022 vide order dated 25th August, 2025 passed by a coordinate Bench. Copy of orders dated 18th July, 2022 and 25th August, 2025 passed in WPA 10519 of 2022 are placed before this Court and same are taken on record.

4) On perusal of the order dated 25th August, 2025 it transpires that petitioner being one of the promotees was impleaded as respondent in writ petition being WPA 10519 of 2022. If today prayer of the petitioner in the present writ petition is allowed in that event issue raised in WPA 10519 of 2022 may become infructuous.

5) Hence, at this stage present writ petition is not maintainable.

6) Writ petition stands dismissed.

7) However, this order shall not preclude the petitioner from agitating his grievance relating

to preparation of gradation list dated 16th June, 2025 in pending writ petition being WPA 10519 of 2022 by taking steps in accordance with law. 8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
