Kausik (Rejected) CRM (M) 2651 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kharagpur (Local) Police Station Case No. 970 of 2024 dated November 17, 2024 under Sections 118(1)/118(2)/109(1)/103(1)/61(2)/3(5) of the BNS.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 23 days and the principal accused has already been arrested in connection with the instant case.

Learned advocate prays for bail as there has been no progress in the case and unnecessarily the petitioner is languishing in jail.

Learned advocate for the State, on the other hand, submits that 3 accused persons acted conjointly and in conspiracy with each other, consequent to which the incident happened. It has also been submitted on behalf of the State

that the bail prayer of one of the co-accused has already been rejected by this Hon'ble Court.

Having regard to the materials appearing in the case diary, at this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 2651 of 2025 is dismissed. Records of the case reflect that there are 20 witnesses. Accordingly, I direct that in case the proceedings have not been committed to the Court of Sessions within one month from the next date so fixed, the case be committed to the Court of Sessions after supplying the copies which have been relied upon by the prosecution. Learned Sessions Court on receipt of the records within a period of 45 days will consider the charges.

Petitioner would be at liberty to renew his prayer for bail after the stage of consideration of charges are over. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
