Ms. Madhumita Basak ....for the State Learned senior advocate appearing on behalf the petitioner submits that petitioner is in custody for about 1 year 9 months and the subject matter of the case relates to recovery of 9.081 kg. of opium.

The investigation of the case has already been concluded, charges have been framed and presently three witnesses out of proposed 20 witnesses have been examined. Learned Public Prosecutor appearing on behalf of the State submits tabular chart in the form of a report prepared by the investigating officer.

It has also been stated in the report that the prosecution intends to examine 5 more witnesses.

Reference has also been made in the order passed in CRM (NDPS) 1051 of 2025 where the prayer for bail of one Jagdish Chakma, a co-accused in the case has been rejected with a direction to conclude the trial preferably within a period of eight months from the next date of hearing. Such order was passed on September 18, 2025 by the Co-ordinate Bench. Majority of the period is still left and the prosecution intends to examine 5 witnesses. The fact that commercial quantity of contraband was seized, at this stage I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1599 of 2025 is dismissed.
