Learned advocate appearing for the petitioner submits that the petitioner is in custody since April, 2025 and till date the investigating agency could not establish any substantial materials for implicating the present petitioner. Petitioner has been arraigned in the case on the basis of statement of co-accused and there has been no recovery in the present case so far as the present petitioner is concerned.

On the other hand, learned advocate appearing for the NCB opposes the prayer for bail and submits that there are call data records which will reflect a close association of the present petitioner with one of the co-accused. Within a short span of time, there were huge number of calls and to that effect investigation is in progress. There is a history also of exchange of property and money

trail which the investigating agency had been unearthed. Learned advocate for the NCB further submits that delay was never contributed because of the prosecution but account of discharge application being filed. It has also been pointed out that there are four other criminal cases pending so far as the present petitioner is concerned and two other cases are under the provisions of NDPS Act.

Having considered the quantum of seizure in this case, the relationship which the investigating agency is working out and the prima facie materials appearing, at this stage, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM(NDPS) 1619 of 2025 is rejected.
