The petitioner challenges a tender process issued by Dubrajpur Municipality for the collection of service tax. The Municipality is alleged to have extended the deadline for submitting the bids twice, beyond the prescribed rules, to favour the lowest bidder.

The learned advocate representing the State submits that the petitioner did not apply for the tender.

In my view, since the petitioner did not participate in the tender process, he cannot maintain this writ petition. Allegations of arbitrariness in the tender process, raised by the petitioner, cannot be adjudicated in the absence of his participation. Accordingly, WPA 28241 of 2024 is dismissed.
