This is an application praying for direction upon the respondent authorities to allow the petitioner to participate in the next round of counselling i.e., special stray vacancy round to take admission for pursuing a course in medicine. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was issued a provisional allotment letter at the third round counselling for the IQ City Medical College, Mohunbagan Avenue, Durgapur. When the petitioner visited the respondent College seeking information about the management quota fees as well as the admission fees, he was asked to deposit fees of three semesters to take admission. This caused delay in arranging for the fees and admission could not be taken. In view of the same, the petitioner wants to participate in the special stray vacancy round.

Learned counsel for the NMC denies the allegations and submits that the date has already passed for taking admission. The petitioner could not be permitted to participate in the special stray vacancy round. The notification dated 25.11.2024 does not relate to a candidate who was allotted a seat, but could not take admission.

The petitioner's prayer is also opposed by the WBMCC, the respondent University and the State.

It does not appear that the notification in question pertains to the petitioner.

It is also a disputed question of fact whether the petitioner was actually asked to pay three times semester fees for taking admission.

Therefore, this Court does not find any merit in this application.

Accordingly, the writ petition is dismissed, however, without any order as to costs.
