Basu Mallik Mr. Biman Halder ... for the DPSC, Hooghly The petitioner was a primary school teacher who has retired on superannuation on 31.01.2020. He had joined his service on 20.08.2010 after verification of documents as to Exempted Category. Thus, he is short of for six months 18 days' qualifying service for getting pensionary benefits.

I direct the Principal Secretary to the Government of West Bengal, School Education Department to consider the case of the petitioner in a sympathetic manner as to whether the shortfall in qualifying service can be condoned and the petitioner can get the pension. If necessary, the petitioner should be given an opportunity of hearing. The entire exercise is to be done by three months from the date of communication of this order.

However, while considering this, no Act or Rule is to be bent by the Principal Secretary.

With this observation and direction, this writ application is disposed of.
