Mr. Bidyut Kmar Roy is present in Court is requested to appear in this matter on behalf of the State. His appointment may be regularized by the concerned authority.
The contention of the petitioner is that, the petitioner is in custody from November 2021 in Gaighata Police Station Case No.997 of 2021.
Learned advocate for the petitioner submits that although his client is in custody for a long period but the trial of this case has not yet started. It appears from the record that the case was fixed for trial on 5.11.2022 but the case was adjourned on the ground that several NDPS cases are pending. The next dates fixed for hearing are 27.01.2023, 30.01.2023 and 31.01.2023.
Upon hearing the learned advocate for the petitioner and learned advocate for the State, this Court is of the view that as the petitioner accused in custody for more than one year, this case should be disposed of expeditiously without any unnecessary adjournment.
Thus, this revisional application stands disposed of. Learned Additional District and Sessions Judge, 6th Court, Barasat is requested to dispose of the case N 150 of 2021 pending before him within a period of four months from the next date fixed.
