Tirthankar Ghosh Mr. Dipanjan Dutt Mr. Tanmoy Roy ....for the petitioner Learned counsel for the petitioner submits that the petitioner herein is aggrieved with the paltry maintenance amount awarded in Case No.C-1406 of 2022 by the learned Chief Judicial Magistrate, Barasat. However, the petitioner has been instructed that only an appeal lies against the said impugned order but inadvertently the petitioner has preferred the instant revisional application before this High Court. Accordingly, he prays for withdrawal of the instant application with liberty to prefer appeal before the appropriate authority. Having heard the learned counsel for the petitioner, the application being CRR 5260 of 2025 is dismissed as withdrawn with liberty to the petitioner to prefer appeal before appropriate forum subject to the provision of other laws including Section 14 of the Limitation Act.

Petitioner will be at liberty to take back the certified copy of the impugned orders on production of authenticated copy of the same.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
