(Through Video Conference) Mr. Anirban Roy ..for the State This petition was filed in the year 2017 seeking a direction to the respondents to take steps by amending the Motor Vehicles Act and Rules to bring the battery operated three wheelers passengers under the Motor Vehicles Act.

Learned counsel for the respondents has pointed out that the Notification dated 27th of April, 2015 was issued by the Department of Transport, Government of West Bengal directing the RTAs to take necessary action for registration of e-rickshaw within their jurisdiction subject to fulfilment of applicable criteria in this regard. The similar writ petition being WPA(P) 202 of 2021 (Rama Prasad Sarkar vs. The State of West Bengal and Ors.) has already been dismissed by the order dated 13th of December, 2021 taking note of the earlier orders of this Court dated 17th of August, 2018 passed in WP 3930 (W) of 2018 and RVW No.144 of 2018 order dated 5th of August, 2019.

Having regard to the aforesaid, we are of the opinion that no further direction in the present writ petition is required which is also accordingly dismissed. (Prakash Shrivastava, C.J.) (Rajarshi Bharadwaj, J.)
